General
The Tri-State Better Business Bureau, Inc. (BBB) encourages you to use our Weblog, however, you are required to be respective of the rights and responsibilities related to this blogging service and are subject to our terms and conditions of use.

By creating or contributing to any blogs hosted at www.BBBConsumerEducation.com (BBB Weblog), and in consideration for the blogging services we provide to you, you agree to abide by all terms and conditions of use of the BBB Weblog. Please read these Terms and Conditions of Use carefully before posting to or creating any blog. If you do not agree with any of these terms of use, please do not use this site.

Publication
The nature of blogging is to reach a public audience. Be aware that any information that you submit may be publicly displayed on www.BBBConsumerEducation.com or on websites not within our control. If you don’t want others to see such information, do not submit it.

Rights to Blog Content
Unless you specify otherwise, any and all works of authorship copyrightable by you and posted by you to the BBB Weblog (Blog Content) may be copied, distributed, and/or displayed, royalty-free. No party shall be required to credit your authorship any time they copy, distribute and/or display your works of authorship. This shall include derivative works.

The BBB is not required to confirm that you are credited with authorship of your Blog Content, or any derivation thereof. Further, the BBB shall not be required to protect any rights you may have, if any, to your Blog Content.

By creating or contributing to the BBB Weblog, you grant the BBB a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, copy, modify, display, archive, store, distribute, reproduce and create derivative works from such information, in any form, media, software or technology of any kind now existing or developed in the future, including but not limited to incorporating it into a collective work.

When publicly displaying, reproducing or distributing copies of your Blog Content, or any portion thereof that is incorporated into a collective work, the BBB has the right, but not the obligation, to credit your authorship. You grant the BBB permission to use your name for such attribution purposes. You, likewise, agree to represent yourself accurately.

Posting Content
You may post content freely, so long as the content is not illegal, obscene, defamatory, false, threatening, abusive, malicious, infringing of intellectual property rights, invasive of privacy, or otherwise injurious or objectionable. The content may not include profanity.

You may not use the BBB name to endorse or promote any product, opinion, cause or political candidate. Promotions and advertisements or products or services are prohibited. Excessive and/or inappropriate content or links, as determined in the sole discretion of the BBB, are prohibited.

By posting content, you warrant and represent that you either own or otherwise control all of the rights to that content, including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the content, or that your use of the content is a protected fair use. You agree that you will not knowingly and with intent to defraud provide material and misleading false information. You represent and warrant also that the content you supply does not violate these terms and conditions, and that you will indemnify and hold the BBB harmless for any and all claims resulting from content you supply.

Representation of your personal opinions as endorsed by the BBB is strictly prohibited.

You acknowledge that the BBB will pre-screen and review all content prior to it being publicly posted. Notwithstanding such postings, the BBB shall have the right to remove any posting if, in our sole discretion, it contains any content that it considers to violate these terms and conditions. Notwithstanding anything in the policy to the contrary, the BBB shall have the sole discretion to determine whether content that is submitted may be posted. The BBB shall strive to review comments in a timely manner. Comments should not be resubmitted if they do not appear right away. The BBB reserves the right, in our sole discretion, to edit or delete content and will omit all business names from Blog Content.

You understand that all content posted to the BBB Weblog is the sole responsibility of the individual who originally posted the content. You understand, also, that all opinions expressed by users of this site are expressed strictly in their individual capacities, and not as representatives of the BBB, our officers, directors, employees, or the Council of Better Business Bureaus.

Subscribing to Comments via Email
You may elect to receive notification of a comment left after your comment. A valid email address is required to receive said notification. You will not be subscribed to an email list as a result of subscribing to receive notification. You may change your preferences by visiting the comment subscription manager.

Weblog Use
The BBB Weblog is intended for individuals 18 years of age and older. Use by individuals under the age of 18 is prohibited. If you are a parent or legal guardian of a child under age 18 who is posting information on the BBB Weblog, or otherwise have knowledge of an individual under the age of 18 using this site, please contact our administrator at info@evansville.bbb.org to notify us of a suspected violation.

The BBB may, in our sole discretion, terminate or suspend access to all or part of the site, including, but not limited to, any bulletin boards on our site, for any reason, including without limitation, breach of this policy. In the event access is terminated, the terms and conditions shall survive any such termination.

Access by BBB and Third Parties
Available log records, and all data stored on BBB servers may be accessed by our system administrators. The system administrators may produce these records and data to the President of the BBB, the BBB Board of Directors or other BBB employees and agents upon request or upon suspected violation of our terms of use. Further, it is the BBB’s policy to cooperate with law enforcement officials in the detection, investigation, and prosecution of unlawful activity. If we receive a warrant or subpoena for user information, we may disclose requested records to law enforcement authorities or outside parties seeking information through the legal process.

You understand and agree that the BBB, our officers, directors, employees, and the Council of Better Business Bureaus will not be liable, under any circumstances and in any way, for any errors or omissions, loss or damage of any kind incurred as a result of use of any content posted on this site. You further understand and agree that you must evaluate and bear all risks associated with the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

This site is provided on an as is and as available basis. The BBB makes no representations or warranties of any kind, express or implied, as to the site’s operation or the information, content or materials included on this site. The BBB hereby disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for any particular purpose. The BBB will not be liable for any damages of any kind arising from the use of or inability to use this site. You expressly agree that you use this site solely at your own risk.

Amendments
The BBB reserves the right to change and amend, at any time, at our sole discretion, the terms and conditions under which these services are offered. You are responsible for regularly reviewing these terms and conditions. Your continued use of the BBB Weblog service constitutes your agreement to all such terms and conditions.

Jurisdiction
The BBB Weblog is controlled and operated by the BBB from its offices in Evansville, Indiana. This agreement shall be governed by and construed in accordance with the laws of the State of Indiana, as it is applied to agreements entered into and performed within that State. Any action brought to enforce this agreement or matters related to the site shall be brought in either the State or Federal Courts located in Vanderburgh County, Indiana. If any provision hereof is deemed void, unlawful or otherwise unenforceable for any reason, that provision shall be severed from this agreement and the remaining provisions of this agreement shall remain in force. This contains the entire agreement between you and the BBB concerning your use of the BBB Weblog.
